1. About CYMSTAR Designs

This website is operated by CYMSTAR Designs, based in Ontario, Canada. Throughout these terms, “CYMSTAR,” “CYMSTAR Designs,” “we,” “us,” and “our” refer to that business.

These Terms of Service apply to purchases through our website and your use of the website. Please review them together with our Refund Policy, Privacy Policy, Shipping Policy, and the information provided on the relevant product page and at checkout.

2. Your consumer rights

Nothing in these terms or our other policies excludes, restricts, or replaces any warranty, cancellation right, refund entitlement, or other protection that cannot lawfully be excluded.

If a provision conflicts with mandatory applicable law, that law prevails. Any limitation or exclusion in these terms applies only to the extent permitted by law.

3. Eligibility and order information

To place an order, you must have the legal capacity to enter into a binding purchase agreement or act with the authorization of a parent or legal guardian.

You agree to provide accurate and complete order, payment, email, and delivery information and to use a payment method you are authorized to use.

Please check your order carefully before submitting it. If you notice an error, contact us promptly. We will make reasonable efforts to assist, but changes may not be possible once production or shipping begins.

4. Made-to-order products

Unless a product listing states otherwise, our products are manufactured, printed, or prepared after an order is placed.

“Made to order” describes our production process. It does not necessarily mean that an item is individually tailored, personalized, exclusive to one customer, or the only item produced with that design.

We work with production and fulfilment partners, including partners outside Canada. Products may be manufactured or shipped from different locations, and items in one order may arrive separately.

Our use of these partners does not remove our responsibilities to you as the seller.

5. Sizing, fit, colours, and product descriptions

Please review the size chart and measurement instructions for each product before ordering. Sizes may differ between products and manufacturers.

Some charts show body measurements; others show measurements of the finished garment. Follow the instructions provided with the particular chart. When garment measurements are supplied, comparing them with a similar garment that fits comfortably can help you choose your size.

Unless expressly offered, our garments are not made to your individual body measurements. We cannot guarantee a particular fit where the item supplied matches the size ordered and its stated specifications.

Product photographs and mockups illustrate the design and intended appearance. Screen settings, lighting, materials, and production methods may cause minor differences in colour or appearance.

These explanations do not excuse supplying the wrong item, a defective item, or a product that materially differs from its description. Any applicable manufacturing or measurement tolerances will be identified in the relevant product information.

6. Prices, payments, and order acceptance

Prices are shown in the currency displayed when you shop and at checkout. Applicable taxes, shipping charges, and other charges collected by us will be disclosed before you complete your purchase.

Your payment provider may impose currency conversion or other fees under its own terms.

An automated order confirmation acknowledges receipt of your order. Acceptance occurs when we send a production confirmation or shipping confirmation, whichever occurs first.

Before acceptance, we may decline an order for a legitimate reason, including suspected fraud, an unavailable product, a material listing error, or an inability to fulfil the order.

If a material pricing or description error affects your order, we will contact you to explain the issue. We will not charge you an increased price or substitute a materially different product without your agreement.

If we decline or cancel an order, we will notify you and refund any payment collected for the cancelled items, including associated charges where applicable or required by law.

Price changes apply to future purchases and do not automatically change accepted orders.

7. Customer cancellations and changes

Because production may begin shortly after ordering, we cannot guarantee that a voluntary cancellation, size change, design change, or address correction can be accommodated. Once production begins, we generally cannot accept changes or cancellations for a change of mind.

This restriction does not affect cancellation or refund rights provided by applicable law, or remedies where we cannot fulfil your order.

8. Shipping and delivery

Production and shipping estimates are provided in the relevant product information, Shipping Policy, or checkout. Production time and carrier transit time are separate.

Unless expressly described as guaranteed, delivery dates are estimates. If a significant delay arises, we will communicate available information and any options or remedies required by law.

Please provide a complete delivery address and contact us promptly about delivery problems. We will investigate lost, damaged, or incorrectly delivered shipments with the relevant fulfilment partner or carrier.

A carrier’s delivery scan does not, by itself, remove any rights you may have under applicable law.

If an incorrect address supplied by you causes an additional delivery cost, we will explain any proposed charge before collecting it.

For international orders, the checkout or Shipping Policy will explain whether import duties, taxes, or customs handling charges are included or may be payable on arrival. Charges collected by us will be disclosed before purchase.

9. Returns, defects, and refunds

Our Refund Policy forms part of these terms.

Because products are made to order, we generally do not accept returns or exchanges for a change of mind or an incorrect size selection where we supplied the product ordered in accordance with its description. This is subject to applicable consumer rights.

If an item arrives damaged, defective, incorrectly manufactured, or different from what you ordered, please contact us promptly.

We ask that visible issues be reported within 5 days of delivery to help us investigate quickly. This request does not extinguish statutory rights or automatically exclude defects discovered later.

Please provide your order number, a description of the issue, and clear photographs where reasonably possible. Keep the item and available packaging while we review the concern.

Contact us before returning an item so we can provide appropriate instructions. We will explain whether a return is necessary, who is responsible for shipping costs, and the applicable refund or other remedy.

We will provide remedies required by law and honour any additional commitments in our Refund Policy. Refunds will ordinarily be issued to the original payment method; processing time may depend on your payment provider.

We understand that exceptional situations can arise and may review individual concerns on a case-by-case basis. Any additional accommodation is discretionary and does not reduce your legal rights.

10. Intellectual property

Our branding, original designs, photographs, graphics, text, and website materials are owned by CYMSTAR or used with permission, except where otherwise identified.

Purchasing a product does not transfer intellectual property rights in its design or branding. You may not reproduce our protected materials for commercial use without appropriate permission, except as permitted by law.

Nothing in these terms limits lawful rights concerning resale, fair dealing, or other permitted uses.

11. Reviews and customer submissions

If you voluntarily submit a review or content intended for public display, you grant us a non-exclusive, royalty-free permission to display and reproduce it in connection with our products and business, subject to applicable law and any consent requirements.

You retain ownership of your content. You must have the right to submit it and must not include unlawful material or infringe another person’s rights.

Private customer service messages, order details, and photographs submitted to resolve a defect claim are not automatically authorized for advertising use.

We may moderate unlawful, abusive, fraudulent, or irrelevant submissions. We will not knowingly alter a review to misrepresent the customer’s experience.

12. Privacy and third-party services

Personal information is handled as described in our Privacy Policy.

We use third-party providers for services such as operating our online store, processing payments, manufacturing products, fulfilling orders, and delivering purchases. Relevant handling of personal information is described in our Privacy Policy.

Links to independent third-party websites are provided for convenience. We do not control those websites, and their own terms and privacy practices apply when you use them.

This does not exclude our responsibility for products we sell or services we arrange to fulfil your order.

13. Acceptable website use

You must not use the website for fraud, unlawful activity, unauthorized access, distribution of malicious software, infringement of intellectual property, or harassment.

We may restrict access where reasonably necessary to address misuse, security concerns, or legal requirements. Restricting website access does not cancel our outstanding obligations concerning an existing purchase.

14. Website availability and liability

We take reasonable care in operating the website, but cannot promise uninterrupted access or a website free from technical errors. We may carry out maintenance or modify website features.

To the extent permitted by law, we are not liable for indirect or consequential losses, including lost business profits, arising from use of the website or a purchase.

This limitation does not exclude liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded or limited.

It does not remove obligations to supply purchased goods, provide legally required refunds, or honour mandatory product protections.

15. Events beyond reasonable control

Events outside our reasonable control may affect production, shipping, or website availability. We will take reasonable steps to reduce their impact and communicate material delays where practicable.

Such events do not remove any cancellation, refund, or other rights available under applicable law.

16. Questions and disputes

Please contact us at contact@cymstardesigns.com if you have a concern. We will review it in good faith and seek a fair resolution.

You are not required to give up access to courts, consumer protection agencies, payment dispute procedures, or other remedies available by law.

17. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, subject to mandatory consumer protections and jurisdiction rights that apply where you live.

18. Changes and general provisions

We may update these terms and will show the revised date at the top of this page. Unless otherwise lawfully agreed, the terms and policies applicable when an order is placed govern that purchase.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A failure to enforce a provision immediately does not automatically waive the right to enforce it later.

These terms and the policies and product information incorporated into your purchase form the agreement concerning that purchase, without excluding representations or rights that applicable law protects.
